N.J. appellate court finds employer may be liable for employee use of Internet porn in Dec., 2005 decision

SALT LAKE CITY - Jan. 23, 2006 - On December 28, 2005, a New Jersey appellate court held that an employer may be held financially liable for an employee's use of Internet pornography. Increasingly, unwanted Internet content is not only a business productivity problem, but a potential legal liability as well.

In the New Jersey case, the decision by the appellate court has overturned a lower-court ruling in favor of the employer.

The Appellate Division panel stated: "We hold that an employer who is on notice that one of its employees is using a workplace computer to access pornography, possibly child pornography, has a duty to investigate the employee's activities and take prompt and effective action to stop the unauthorized activity. No privacy interest of the employee stands in the way of this duty on the part of the employer."
