ContentWatch Addresses Business Liability from Workplace Internet Abuse

N.J. appellate court finds employer may be liable for employee use of Internet porn in Dec., 2005 decision

ContentProtect gives companies a solution for as little as $40 per node, per year

SALT LAKE CITY - Jan. 23, 2006 - On December 28, 2005, a New Jersey appellate court held that an employer may be held financially liable for an employee's use of Internet pornography. Increasingly, unwanted Internet content is not only a business productivity problem, but a potential legal liability as well.

In the New Jersey case, the decision by the appellate court has overturned a lower-court ruling in favor of the employer.

The Appellate Division panel stated: "We hold that an employer who is on notice that one of its employees is using a workplace computer to access pornography, possibly child pornography, has a duty to investigate the employee's activities and take prompt and effective action to stop the unauthorized activity. No privacy interest of the employee stands in the way of this duty on the part of the employer."

ContentWatch, a top-rated provider of Internet filtering solutions for families and businesses, is working to provide employers with cost-effective, high performance and easy-to-use solutions to eliminate unwanted Internet content in the workplace. ContentWatch's flagship product, ContentProtect Professional 2.0, can give small to medium organizations the protection they need for as little as $40 per node, per year.

In addition to liability issues, sources estimate the salary costs for non-work activities to be as high as $759 billion per year. A recent IDC study reported that, as much as 40% of Internet use in the workplace is not related to business. Unfortunately, the workplace has become a more common venue for Internet pornography, with a reported half of Fortune 500 companies having dealt with at least one incident in the past 12 months.
